Terms of Sale

1. Purpose and scope

These terms of sale govern the sale of food supplements by STATE SASU, share capital 1,000 euros, registered office 18 rue du Portail-Neuf, 83990 Saint-Tropez, France, registered with the Trade and Companies Register of Fréjus under number 934 512 876, VAT number FR12 934512876, to any consumer placing an order on state-care.com.

Placing an order implies full and unreserved acceptance of these terms. STATE SASU may amend them at any time; the version applicable to an order is the one in force on the date the order is placed.

2. Products

Our products are food supplements within the meaning of Directive 2002/46/EC and French Decree No. 2006-352. They are not medicinal products. They do not prevent, treat or cure any disease and are not a substitute for a varied, balanced diet and a healthy lifestyle.

The information published on each product page, in particular the composition, the recommended daily dose, the precautions for use and the allergens, forms an integral part of these terms. The customer is invited to read it before ordering.

Product photographs are illustrative. Minor variations in colour or packaging do not constitute a lack of conformity.

Our products are manufactured in France. Each batch is traceable from raw material to finished jar.

3. Prices

Prices are shown in euros, inclusive of French VAT at the rate applicable to food supplements, and exclusive of delivery costs, which are indicated separately before the order is confirmed.

STATE SASU reserves the right to change its prices at any time. The price applicable to an order is the one displayed at the moment the order is placed.

For deliveries outside France within the European Union, the VAT rate of the country of destination may apply in accordance with the applicable rules on distance selling.

4. Orders

The order process comprises the following steps: selection of products and quantities, verification of the cart, entry of delivery and billing details, choice of delivery method, choice of payment method, review of the complete order and its total price, then final confirmation.

The final confirmation constitutes an obligation to pay. An acknowledgement of receipt summarising the order is sent by email. The contract is formed when STATE SASU confirms the order.

STATE SASU reserves the right to refuse or cancel any order from a customer with whom a dispute is ongoing, any order that appears abnormal, made in bad faith, or placed in quantities suggesting a commercial resale purpose.

5. Payment

Payment is due in full at the time the order is placed. Accepted payment methods are displayed at checkout and include the main bank cards as well as the alternative methods offered by our payment providers.

Transactions are secured by our providers, which are PCI DSS certified. STATE SASU never has access to your full card details.

In the event of a payment refusal by the bank, the order is automatically cancelled.

6. Subscriptions

Where a subscription option is offered, the customer is informed before confirmation of the delivery frequency, the price of each delivery and the applicable discount.

Subscriptions are without commitment. They may be paused, modified or cancelled at any time from the customer account or by writing to contact@state-care.com, at the latest forty-eight hours before the next renewal date. Deliveries already dispatched cannot be cancelled.

7. Delivery

Delivery areas, times and costs are described in our Shipping and Returns policy, which forms an integral part of these terms.

In accordance with Article L216-1 of the French Consumer Code, delivery takes place no later than thirty days after the order, unless a different date is agreed. In the event of a delay, the customer may cancel the order under the conditions provided for in Article L216-6 and obtain a refund within fourteen days.

8. Right of withdrawal

In accordance with Article L221-18 of the French Consumer Code, the customer has fourteen days from receipt of the goods to exercise the right of withdrawal, without having to give reasons and without penalty.

Important exception applicable to food supplements. In accordance with Article L221-28 5° of the same Code, the right of withdrawal cannot be exercised for goods sealed for reasons of health protection or hygiene which have been unsealed after delivery. A jar whose seal or protective film has been opened therefore cannot be returned or refunded.

To exercise the right of withdrawal, the customer notifies STATE SASU of the decision by any unambiguous statement sent to contact@state-care.com before the deadline expires. The products must then be returned, unopened and in their original condition, within fourteen days of that notification.

Return costs are borne by the customer, except where the product is defective, damaged or does not correspond to the order.

Reimbursement, including standard delivery costs, is made within fourteen days of receipt of the returned goods, using the same payment method as the original transaction.

9. Legal guarantees

All our products benefit, without additional cost, from the legal guarantee of conformity provided for in Articles L217-3 and following of the French Consumer Code, and from the guarantee against hidden defects provided for in Articles 1641 and following of the Civil Code.

Under the legal guarantee of conformity, the consumer has two years from delivery to act, and may choose between repair and replacement of the goods, subject to the cost conditions provided for by law. The consumer is exempt from proving the existence of the lack of conformity for twenty-four months following delivery.

These guarantees apply independently of any commercial gesture made by STATE SASU. To invoke them, write to contact@state-care.com.

10. Liability and precautions of use

STATE SASU cannot be held liable for damage resulting from use of the products that does not comply with the instructions and precautions indicated on the label and on the product pages, in particular exceeding the recommended daily dose.

The customer undertakes to read the composition of each product before use, notably in the event of an allergy. Products containing fish derivatives are clearly identified as such.

Any person under medical treatment, pregnant or breastfeeding, suffering from a chronic condition, or intending to give a product to a minor, should seek the advice of a doctor or pharmacist before use.

STATE SASU cannot be held liable for the unavailability of the website, for events beyond its control, or for damage resulting from force majeure.

11. Personal data

The processing of personal data is described in detail in our Privacy Policy. The customer may exercise the rights granted by the GDPR at any time by writing to contact@state-care.com.

12. Complaints, mediation and dispute resolution

Any complaint should first be addressed to STATE SASU at contact@state-care.com, so that an amicable solution can be sought. Our team answers Monday to Friday, 9am to 6pm CET.

In accordance with Articles L612-1 and following of the French Consumer Code, if no satisfactory solution is found within sixty days, the customer may have free recourse to the consumer mediation service to which STATE SASU belongs:

The customer may also use the European Online Dispute Resolution platform, available at ec.europa.eu/consumers/odr.

13. Applicable law and jurisdiction

These terms are governed by French law. In the absence of an amicable settlement, the competent courts shall be those designated by the applicable rules of civil procedure, the consumer being entitled to bring proceedings before the court of the place where they resided at the time the contract was concluded or where the harmful event occurred.

14. Entirety

If any provision of these terms is held to be invalid, the remaining provisions remain fully applicable.
